These Terms of Service ("Terms") govern your use of the Trace mobile application and related services (the "Service"). By creating an account or using the Service you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Service.
Trace is a personal wellness logging and coaching tool. You record health and lifestyle information, and the Service organizes it, analyzes it for patterns, and provides coaching-style responses generated with artificial intelligence.
The Service is not a medical device and does not provide medical advice, diagnosis, or treatment. Content produced by the Service — including AI coaching responses, pattern findings, and reports — is for informational purposes only, may be inaccurate or incomplete, and must not be relied on as a substitute for professional medical judgment. Always consult a qualified health provider about medical conditions, medications, or symptoms, and never delay or disregard professional advice because of the Service. If you may be experiencing an emergency, call your local emergency number.
You must be at least 18 years old to use the Service. You are responsible for your account credentials and for all activity under your account. You agree to provide accurate information and to use the Service only for your own personal, non-commercial health tracking.
You agree not to: misuse, probe, or disrupt the Service or its infrastructure; attempt to access another person's data; reverse engineer the Service except where permitted by law; use the Service to send unlawful, abusive, or deceptive content (including through the report-sharing feature); or use automated means to access the Service other than interfaces we provide.
You retain all rights to the information you log. You grant us a limited license to host, process, and transmit it solely to operate the Service as described in the Privacy Policy. You are responsible for the accuracy of what you log and for where you choose to send reports.
The Service, including its software, design, and branding, is owned by us or our licensors and is protected by law. These Terms grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices as permitted by the App Store terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE CORRECT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF FIFTY DOLLARS (US $50) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You will indemnify and hold us harmless from claims arising out of your misuse of the Service, your violation of these Terms, or your violation of any rights of another, including recipients of reports you choose to send.
You may stop using the Service and delete your account at any time in Settings. We may suspend or terminate access for violation of these Terms or to protect the Service or its users. Sections 2 and 5–12 survive termination.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and attempt to resolve the dispute informally for 30 days. Unresolved disputes will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction. To the extent permitted by law, each party waives trial by jury and any right to participate in a class action.
We may update these Terms; we will update the effective date and give in-app notice of material changes. Continued use after notice constitutes acceptance.
